This document explains how The Watershop collects, processes and retains your personal data. This policy applies to all personal data we hold whether collected through our website, in person, or through other means.

 At The Watershop we are committed to safeguarding and preserving the privacy of our visitors and customers. This Privacy Policy explains what happens to any personal data that you provide to us, or that we collect from you whilst you visit our site.

Information We Collect

  1. Contact data / Enquiry data
    We may process contact details that you provide to us ("contact data"). This contact data may include your name, address, telephone number, fax number and email address. We may use this contact data to manage your account with us, replying to enquiries, in the processing of quotation requests and the fulfilment of orders. We may also use it to pass on information about relevant products and services that we feel may be of interest to you, but you can opt-out of this at any time. See the Un-Subscribe section below for details on how to do this.

    The legal basis for this processing is based on the negotiation of a potential sale, and the commencement of a contract of sale, and the legitimate interest in furthering this relationship.

    Where no contract yet exists, you can still opt-in to allow us to store & process your information and to receive communications from us regarding products that you may be interested in. To do this, please e-mail the Online Stores Team with your name, company name (if applicable) and address.

    As we are a business to business company, we may also store and process your name, direct dial number and contact e-mail address with regards to the company you are employed with if a contract exists with your company. We may contact you regarding order processing or payment if you have been nominated as the correct person for these types of communications. We will not contact you with promotional material regarding products or services offered by the company, unless you opt-in to receive these. To do this, please e-mail the Online Stores Team with your name, company name (if applicable) and address.
  2. Sensitive Personal Data
    While using our services, you should not need to provide us with sensitive information about yourself ("sensitive data"). Please do not supply your sensitive data to us.
  3. Website data
    We may process data about your use of our website and services ("website data"). The website data may include, but is not limited to your IP address, geographical location, referral source and navigation path through the website. This website data may be processed for the purposes of analysing the use of the website and services, marketing, remarketing and sales activity.

    The legal basis for this processing is our legitimate interests, namely monitoring and improving our website and services and providing our goods and services to interested parties.

  4. Other processing activities
    In addition to the specific purposes for which we may process your personal data set out above, we may also process any of your personal data where such processing is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

Passing Private Data to 3rd Parties

  1. Partner service providers
    We use third party service providers to help us operate our business and our web site and administer activities on our behalf, such as sending out newsletters and managing our live-chat. We may share your information with these third parties for those limited purposes only.
  2. Professional advisers
    We may disclose your personal data to our professional advisers insofar as reasonably necessary for the purposes of managing risks, obtaining professional advice, completing audits and managing legal disputes.
  3. Order Completion
    During the process of completing your order it will be necessary to pass your personal data, such as name, delivery address and phone number to a member of our approved courier network.

    Where we deem it quicker or more economical, we may pass your personal details on to our suppliers to facilitate direct delivery of your goods without the need to route them through our Dublin depot 1st. Please let us know if you would prefer this method not to be used on your order.
  4. Where we provide your personal data to any third party
    Where we share your personal data with any third party, we will ensure this processing is restricted to only the purpose the data is provided for and is protected by appropriate safeguards including ensuring a suitable data policy is in place by the third party.
  5. To comply with legal obligations
    In addition to the specific disclosures of personal data detailed above, we may also disclose your personal data where such disclosure is necessary for compliance with a legal obligation we have to comply with, or in order to protect your vital interests or the vital interests of another individual.

Storing Your Personal Data

  1. Online Security
    The The Watershop website uses a secure layer of encryption in the transmission of sensitive information. The information collected from you through product requests, registration and at the time you place an order will be stored in The Watershop's private database.
  2. Password
    You will be asked to provide a password at the time of registration. We will never ask for this password, please do not disclose it to anyone.

    Please do not share your password within your company. If additional colleagues need access, please let us know at admin@watershop.ie and we will set up the additional log-ins needed with the appropriate security levels for each user.
  3. Payment
    Credit/debit card and PayPal transactions are processed independently of The Watershop by the payment solution provider Stripe.
    PayPal transactions can also be done directly through the PayPal interface, but again, only limited information (name, address, etc) is provided to The Watershop by PayPal.
  4. Offline Security
    The Watershop employ high standards of security in order to protect the private data under its care. Appropriate security measures will be taken to protect against unauthorised access to, or alteration, destruction or disclosure of any personal data held by The Watershop in its capacity as Data Controller.
    Access to and management of customer records is limited to those staff members who have appropriate authorisation and password access.

Retaining and deleting personal data

  1. Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.
  2. We may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

Your rights

  1. Right to request data
    You may instruct us to provide you with any personal information we hold about you; provision of such information will be subject to:
    • your request not being found to be unfounded or excessive; and
    • the supply of appropriate evidence of your identity, plus validation of the email address that we will be sending the data to.

  2. Right to rectification
    If we hold any inaccurate personal data about you, you have the right to have these inaccuracies rectified. Where necessary for the purposes of the processing, you also have the right to have any incomplete personal data about you completed.

    In certain circumstances you have the right to have personal data that we hold about you erased. This will be done without undue delay by anonymising the personal data we hold.

  4. Right to object to direct marketing 
    You may instruct us at any time not to process your personal information for marketing purposes.

    You may un-subscribe from receiving such communications at any time by e-mailing unsubscribe@watershop.ie.

    If you make an objection, we will stop processing your personal data for this purpose. We could in some circumstances still send you information that is not of a strict marketing nature - for instance important relevant product notifications or communications relating to order processing.

Amendments

  1. We may update this policy from time to time by publishing a new version on our website.
  2. You should check this page occasionally to ensure you are happy with any changes to this policy.
